Whiplash Compensation And Fraudulent Claims

Whiplash Compensation And Fraudulent Claims

It has been estimated that fraudulent whiplash injury compensation claims could be costing the insurance industry around £125 million per year, pushing the cost of premiums up for the rest of the motoring community: the average cost of motor insurance in the UK is £360, of which an estimated £120 is paid into fraudsters’ pockets.

Measures taken in the past to reduce the number of fraudulent claims made have also taken their toll on the industry, in some cases delaying payments to genuine whiplash sufferers.

In extreme cases, gangs of criminals have been caught staging car crashes and then making fraudulent whiplash compensation claims. Car Fraud Investigator, Peter Taylor, says that the scam is relatively easy to conduct: two drivable cars can be bought for around £1,000. An extra £800 is then used to buy fully comprehensive car insurance and the remaining £300 is used to purchase third party cover for the other vehicle.

The cars are deliberately crashed and other members of the gang put their names on the claim and claim whiplash injuries. In one instance, each member of a gang claimed £2,500 for whiplash. A further £5,000 was added to the bill to cover the costs of the cars and loss of earnings for each passenger. The total cost of this single scam was £26,000.

However, there is good news for genuine claimants. Recent research has made it easier to detect fake whiplash symptoms. Mainly, the fraudsters let themselves down by not knowing the way whiplash works; the pattern followed by whiplash symptoms is now very clear and predictable, especially in the early stages of the injury.

A study was set up to test this theory, in which a team of doctors were presented with a group of whiplash sufferers; some of these patients were ‘ringers’ who were not injured but faking symptoms. The team of doctors was able to correctly assess the credibility of each case. In some cases, some of the ringers even had genuine whiplash sufferers in their families but were unable to accurately replicate the correct symptoms.

Exaggeration of symptoms is the main ‘giveaway’ in these cases. There is also the fact that obvious findings such as inflammation, muscle spasm, range of motion and the fixation of the vertebral joints cannot be easily faked. Conversely, genuine sufferers have been found to actually minimize or underplay the extent of their injuries and pain for fear of appearing to exaggerate.

Interestingly a study conducted in 1995 by an Australian Research Institute not only found compelling data that supports an organic basis for whiplash pain, but also found that there was no evidence that desire for monetary gain affected the prognosis for whiplash sufferers. The study concluded that the only known way to reliably confirm a patient’s whiplash claim is through ‘blocking’ the affected joints with anesthetic and studying the effects on mobility.

Personal injury law firms have been very pro-active in funding the research into verifying genuine cases and the resulting information should make whiplash compensation claims a lot less stressful for actual sufferers.

How is whiplash compensation calculated?

Posted on 15th March 2011 in Whiplash Compensation

How is whiplash compensation calculated?

How much compensation for whiplash? is a question that is often typed into internet search engines. This reflects the fact that whiplash injuries are extremely common, but that few people really know how the compensation process works.

Every whiplash compensation claim depends on its own individual facts and circumstances, which makes it difficult to give a general rule for how much money can be claimed. However, there are several common factors that are always taken into account, and these will give you a good idea of how much compensation you might be entitled to.

If you have a road traffic accident and suffer whiplash injuries, there is a system in place that is designed to help you claim back any financial losses you may have made as a result of your injuries. You are able to make claims for either general damages or special damages.

General damages are applied to emotional as well as physical injuries, with the general impact that the injuries have had on your daily life taken into consideration. Special damages are more concrete, and cover items that can be attributed a specific cost.

When it comes to calculating how much compensation you are entitled to, one of the main factors taken into account is the amount of pain and suffering that your injuries have caused you. With whiplash injuries, the after-effects can sometimes last for months and this will have a significant bearing on how much compensation you receive.

In addition to the physical and emotional suffering caused by the injuries, the impact on your day-to-day life will also be considered. This can seem like a rather vague concept, but it essentially deals with how much your whiplash injuries have reduced your enjoyment of life and how much they disrupt everyday activities.

Serious whiplash can sometimes lead to conditions such as depression, as well as feelings of anxiety and frustration – all of which plays a role in deciding how much compensation you are due.

Medical reports need to be examined to establish how long you suffered pain from the whiplash injuries, as well as how long the pain is likely to last. Once all of the relevant enquiries have been made, your solicitor will be able to give you a much better idea of how much compensation you can claim.

Car Accident Compensation – Making a Claim after an Accident on the Road

Car Accident Compensation – Making a Claim after an Accident on the Road

If you are involved in a car accident, one of the last things that would cross your mind would be how to go about making a claim for car accident compensation. The experience is scary enough by itself, without the daunting thought of having to deal with solicitors and all the expense that comes with it.

However, no win no fee agreements, introduced after the abolition of government legal aid, were designed to help those injured in accidents make a compensation claim when they may not have thought it would have been possible before. This is because it doesn’t cost a penny to do so, and no legal fees are charged to the victim of the accident.

After an accident, it is understandable to check that everyone is OK and to assess the damage caused. You will be concerned about making sure your vehicle is cleared and that everyone involved is safe.

Car accidents can be a massive financial burden on your life. Firstly there is the cost of the damage to your car (though this is usually covered by the 3rd parties insurance in the event that it is not your fault). Then, there is the cost of any medical treatment that may be needed, as well as extra expenses caused as a result, for example travel that may not have been needed if the accident did not happen. It is in this case where it is feasible to make a claim for car accident compensation.

Claiming Car Accident Compensation for Injuries

For most people, having a car and being able to drive is a necessity if they are to get around, go to work and go about their daily lives. For others, driving is a luxury and an enjoyable experience. Driving offers the freedom of being able to go anywhere you want; far more so than on public transport.

Having a car accident can damage confidence, and cause long-term psychological and/or physical difficulties. In the most extreme cases it can cause death or disability. This unfair twist of fate cannot be repaired by financial means. However, making a compensation claim could certainly help make things a bit easier if your quality of life has been reduced in an accident that wasn’t your fault.

Taking some steps following a car accident can significantly help your claim, these include:

- Checking everyone in your vehicle is OK and find out what injuries have been sustained
- Call the emergency services, most importantly the Police and Ambulance.
- Take the details of other vehicle(s) and driver(s) involved, including of their insurance.
- Make a note of where and when the accident happened, and take pictures. If this isn’t possible try and get someone to do it for you.

Then, get in contact with a personal injury claims company, who will assist you in making your car accident compensation claim. They will be able to put you in contact with an expert solicitor who deals with people who have been unfortunately injured in a vehicle accident every single day, and will know exactly how much compensation you will be entitled to.

The main thing is to not suffer in silence – if you need the money, there is always help at hand.

Injuries Direct has been helping innocent victims claim compensation for their injuries since 1998. While many companies have been and gone over the last decade, Injuries Direct has continued to go from strength to strength. http://www.injuriesdirect.com

Whiplash compensation – How much can I claim?

Posted on 16th November 2010 in Whiplash Compensation

Whiplash compensation – How much can I claim?

As with any other type of personal injury claim, whiplash compensation will vary substantially from one case to the next. When setting the value of whiplash claims, the courts must consider the severity of injuries and their impact on the claimants.

This process can include an examination of any relevant direct and indirect losses, such as medical expenses and loss of earnings. Therefore, it is impossible to accurately determine how much whiplash injury compensation can be awarded in any given case; furthermore, even when it may be possible to formulate a realistic expectation, the court retains the privilege to surprise all those concerned. Notwithstanding this, it is possible to outline a rough estimation as to what damages may be awarded in whiplash injury claims.

It is important to note that whiplash is a condition that is routinely categorised according to the severity of its symptoms. Some systems may adopt a simple classification for whiplash, such as: mild, moderate or severe. Other systems may require a more precise classification of whiplash on a scale of 0-4, with 0 denoting no physical symptoms and 4 describing a serious injury such as a fracture or dislocation.

Mild whiplash injury claims might be expected to attract compensation in the region of £1,000 to £4,500; moderate whiplash injuries can be worth up to £14,500; and compensation for severe whiplash injuries may be as high as £85,000 or more.

Whiplash claims are commonplace in traffic accidents, so obtaining the services of a specialist solicitor who is experienced in dealing such claims is vital in securing the maximum compensation available.
